I saw someone already asking this question in Ron Gotcher's immigration forum.
http://www.immigration-information.com/forums/showthread.php?t=7988
That is a good thing. Lets keep our fingers crossed.

Did anything happen on this front...??
Did he introduce or not??..
All said and done..nothing might pass in the name of comprehensive reform this year...What are the other options for pushing ??

Can you take the job to give us an update on the total amount pledged so far, at certain points in between the thread , as it grows ?
Zoooom thanks for doing this. Anzerraja good work. You two work good as a team.
Twicetwice & Anzerraja, your generous pledge has inspired me to pledge $100 for now, more later.
We should merge all other threads dealing with this issue over here for convenience

I will definitely call senator's office and talk and even take appointment. For me the senators nearest office is 150 miles drive one way. But I will do that.
The House representitive's office is less than half a mile's drive. But he is a member of Toncredo's immigration caucus and it is plain useless to talk to them.
The highlighted message is the key to the next step.
At most times you are likely to get such automated responses and message would be ignored unless backed up by lobbying effort. Each campaign is carefully crafted and the strategy is based on our ongoing lobbying efforts. This is why we ask for a focused message and followup instead of sending junk emails (from online petitions) and thinking our work is done after hitting the submit button. It is a waste of time and energy and misleads the community in what they should be doing to get attention to their issues. Sending email is just one tiny step towards the advocacy work. Next step is to call the office and follow up about the email. Tell them you are not satisfied with such a response on an important issue. Tell them that you want to talk to someone about your letter and also wants to meet them in their office as you are a constituent and part of a national organization. Once you get the appointment, contact IV and we will guide you for the next steps.

I'm not saying that "H-1B job is permanent:" you're inferring again! I hold that *no* job in this country is "permanent" (legally speaking).
......
Look at the I-140 application (Page 2, Part 6, Question 5)
http://www.uscis.gov/files/form/i-140.pdf
I wonder why uscis is asking "Is this a permanent position?", if according to you, "*no* job in this country is "permanent" (legally speaking)"
Did your attorney put No for this question for your I-140 app?
.

Zoooom, Anzeraja & All pledgers,
Thanks for driving this effort. Subsequent to Aman's post, we can direct these pledges to the normal contribution drive for IV.
It was amazing to see such response to call for funds for Aman and other core members.

looks like this case actually tells me that maybe we could do self-employment easily...
The problem with self employment is demonstrate
1. AC-21 job is in same classification as original labor/I-140
2. New job is bonafide
In order to show that the new job is "real", one has to show
1. The business is real, not just paper shop
2. Business Plan, Funding to support employees
3. Any contracts, orders etc
If business is new, it becomes difficult to show that business can offer full time job to someone at say 60k salary per year. Now, if business has some capital funding or line of credit from bank or some long term contracts, then it is relatively easy to show that business can support employees.
The burden of proof, in case of RFE, lies on beneficiary.

Hi Guys
My date is not current but I understand the frustration here. However I beleive USCIS is under severe pressure to reduce the backlogs and not waste any numbers this year....so they are trying to exhaust them as and when they can...in that scenaio I guess lower hanging fruits are getting picked.
But on the bright side as I see it as more and more people get their GCs its a smaller line and the officers should be able to get to everyone's file in due course.
I completely believe the system should be FIFO but then don't you think that will be too logical for the USCIS......
Hopefully if they are able to get a lot of people out of the way they should go back to normal processing from October when new numbers are available and the pressure is somewhat less.....
Again above is my theory. I hope everyone gets their green cards soon and the line keeps moving.
regards
Saket
What is the "LOWER HANGING BALLS" AND "LOWER HANGING SHIT" means? Why can't these assholes approve all the old cases and then move the dates to 2003 or 2004 or even 2006.
These type of analogy is nothing but a bullshit. USCIS under pressure??? What pressure? Who do they care? Why should they worry? Whole immigration system is a circus(jumbo, gemini circus) playing with our lives and with full of jokers making fun of us.

Did anyone see Byron Dorgan's (Democratic Senator from North Dakota)interview on Stephen Colbert last night? This guy just wrote an anit-outsourcing book (http://www.amazon.com/Take-This-Job-Ship-Brain-Dead/dp/031235522X --no I am not plugging his book!) and he is full of 'they stole our jobs' rhetoric. This is typical outsourcing/globalization-bashing democratic mentality and it's disturbing to seeit still persists 2 years after Presedential elections.
Am I the only one who thinks that if Democratics takes over the House, we are screwed?
If the Democrats  win, we will be screwed because the illegals will get all the visas.
If the Republicans   win, we will also be screwed because nobody will get visas.

Your Comment on H2B is only right about H2B and doesn't apply on EB green cards. We are people who came on H1B & our Green Cards were sponsored by US employers, we have our Labor & I-140 approved and we are waiting for Visa number assigned to our applications. So you could be comparing apples to peaches...Immigration policies had been hostile in past 12 years and will continue to be same indefinitely...Now our choice is sit back, lie low, keep watching & read Visa predictions indefinitely- may be another decade or 2- or take some steps, which I think, are not going to face much opposition. Also regarding reason behind so many Indians is, that 200K H1B between 1999 and 2002. Even if visa cap is lifted for 2 years that big hump will be crossed, it may smoothen the Visa allocations for Indians.
Some people are floating in Utopia.
Most of us are here on on the ground.
Keep watching the forums and see how many denials have been posted and we are just at the beginning stages... There are many more denials; revocations; dol audits, arrests coming.
While all this is going on; you can continue to push the envelope and try to increase EB greencards, get rid of country quota and loosen up everything.

You can do all you want and be as blunt. USCIS doesn't have to answer to you. Stop chanting the "HIGHLY SKILLED", paying all taxes, nonsense. You were not brought to the USA at gun point. You chose to come (and stay). The USA can just put one ad in the newspaper anywhere in the world and there will be 10 million highly skilled NEW people they can bring. They do not need you (us). It is important to remember that we are not doing anyone a favor by being here except yourselves.
Again, because USCIS is so BIG and has millions of applications to process they can say they are trying their best and cannot reply to each individual.

Congratulations to everyone who is getting their applications approved.
My PD is Aug 2006 and I might have a remote chance of getting approved this month. Can someone give me the customer service number to talk about the 485 status. I keep seeing that many people talk to the customer service and get updates on the case. My case is pending at TSC. Thanks a lot.
It is the same number which you see on the 485 notice which you have.
select options as if you are checking your status on the phone (i.e. push buttons leading that direction, enter your receipt # listen to your LUD etc.). After that select the option which refers to "you believe you have a problem with your application" section (I think that is option 3). Then select the option which points problem with multiple applications (like if you believe your derivatives application seperated etc.). That one is option #4. That will end up at TSC IO. I hope my intstructions above will be helpful to you.

Whats the game plan here?. What will this letter do?. What if we dont get reply?.
We dont give them any room here. We are not letting them decide anything. We provide them options and they have to choose one. If they dont, we sue them.
Options according to me. Feel free to correct/add folks.
1.Process Green card in a consistent manner and provide Green cards who have been waiting for a while and make it current.
2. Refund every DAMN dollar for all the million applicants who didnt get it.
If they are not choosing either, we are SUING. No second thoughts here. We are under the water already.
